What is an uncontested, no-fault divorce?

An uncontested, no-fault divorce is a divorce between two parties that completely agree on every aspect of the divorce including spousal support, child support, child custody and property division (equitable distribution).

Virginia law will grant an uncontested, no-fault divorce to parties that have been living separate and apart for more than one year. If there are no children born of the marriage or adopted during the marriage, Virginia allows an uncontested divorce to be granted after a six month separation if the parties to the divorce have executed a written separation agreement.
